TERM:
This consignment agreement has a term of 90 days from the date of acceptance of all Consignor merchandise. Couture reserves the right to return any merchandise to Consignor prior to the expiration of the consignment agreement period and for any reason. Should any merchandise remain unsold at the end of the consignment period, Couture will return your items upon request and at the Consignor’s expense. Unless requested by the Consignor, all merchandise left beyond the 90-day consignment period is subject to regularly scheduled markdowns.
CONDITION:
Consignor must disclose to Couture any and all flaws, damage, and/or alternations to the merchandise. In cases where damage or alternations are not disclosed, Couture reserves the right to terminate the consignment agreement at any time. In such cases, the merchandise will be returned to the Consignor at the Consignor’s expense.
OWNERSHIP:
The Consignor guarantees that he/she is the true and lawful owner of any and all merchandise consigned with Couture. Consignor agrees to indemnify and hold harmless Couture for any damages arising from any and all claims, demands, losses, causes of action, damage, lawsuits, judgements, including attorney’s fees and costs, to the extent caused by or arising out of or relating to the unlawful ownership of merchandise.
AUTHENTICITY:
The Consignor guarantees that he/she has agreed to consign 100% authentic goods to Couture. In cases involving the consignment of counterfeit merchandise, Couture will notify Consignor via email or phone. Any Consignor item deemed to be counterfeit or any items that have inconsistencies will be returned to Consignor for a fifty-dollar ($50) processing fee, per item, or will be destroyed or discarded.
PROCEEDS/PAYMENTS:
Payments are made between the 10th and 20th of each month for the items sold during the prior month. Items purchased on layaway are not considered sold until paid in full. Any payments not claimed by Consignor after a period of one (1) year following the merchandise sale date will be forfeited.
RISK OF LOSS:
Upon acceptance of all consigned merchandise, Couture will assume full responsibility for all items until they have been delivered to a respective buyer or has been returned to Consignor.
AGREEMENT:
This agreement may not be modified unless agreed to in writing and signed by both Couture and Consignor. All reasonable disputes will be directed to the Hillsborough County better business bureau within the state of Florida where the dispute will be handled accordingly.
In consideration of the mutual promises and condition contained in this agreement, Seller agrees to sell to Buyer and Buyer agrees to purchase from Seller on the terms, conditions, warranties, and representations set forth in this Agreement.

The Seller guarantees that he/she is the true and lawful owner of any and all merchandise agreed to be purchased by the Buyer. Seller agrees to indemnify and hold harmless Buyer for any damages arising from any and all claims, demands, losses, causes of action, damage, lawsuits, judgements, including attorney’s fees and costs, to the extent caused by or arising out of or relating to the Seller’s unlawful ownership of merchandise.
AUTHENTICITY:
The Seller guarantees that he/she has agreed to sell 100% authentic goods to Buyer. In cases involving the sale of counterfeit merchandise, Buyer will notify Seller via email or phone within ten (10) business days from the date upon which the Buyer takes possession of the merchandise. Seller will be required to refund the Buyer the purchase amount within 72 hours of notification as well as a fifty-dollar ($50) processing/return fee per item.
CONDITION:
Seller must disclose to Couture any and all flaws, damage, and/or alternations to the merchandise. In cases where damage or alternations are not disclosed, Buyer will notify Seller and decide appropriately whether pricing can be adjusted or if items must be returned to Seller at Seller’s expense.
PROCEEDS/PAYMENTS:
Buyer and Seller will mutually agree on a price as part of this agreement. Buyer agrees to process payment for all goods within three (3) business days following the receipt and acceptance of goods. Buyer reserves the right to extend this payment period at it’s sole discretion in cases where goods require further review or authenticity verification.
AGREEMENT:
This agreement may not be modified unless agreed to in writing and signed by both Buyer and Seller. All reasonable disputes will be directed to the Hillsborough County better business bureau within the state of Florida where the dispute will be handled accordingly.
